Ideal-Hosting UG (haftungsbeschränkt) ("The Company") agrees to provide services to you ("The Client") under the following TOS ("Terms of Service"). Clients will be held responsible for all actions performed by their account and are responsible for the security of the account. The Company reserves the right to modify the TOS or AUP ("Acceptable Use Policy") at any time, and agrees to notify all clients of changes to the aforementioned documents via email to the address provided by the Client. It is the resonspibility of the client to provide a working email address to the Company. In the event of a modification of the TOS or AUP by the Company, the Client reserves the right to discontinue use of the services provided by the Company with no additional cost or delay.
The Client agrees to pay a monthly Invoice to Ideal-Hosting UG (haftungsbeschränkt) an amount agreed upon by both the Company and the Client. If after 5 days the Company has not received a payment for the aforementioned Invoice to the Client, all services of the Client will be suspended until the invoice is regarded as paid or until 30 days have passed, at which point all Client services will be terminated totally and completely. In the event of a termination of service, the Client will not receive any data or information gathered or stored from the service and all data or information from the service in question will be subsequently deleted.
All services provided by the Company to Clients who have not before purchased a service from the Company come with an unconditional money-back guarantee lasting 7 days after activation of services. If the Client wishes to terminate their service within the 7-day period, all refunds must be handled through the Company's support ticket system. The Company does not recognize and does not provide refunds through any other method. In the event that the Client abuses server resources, bandwidth, or both in the time that the services of the Client were active, the Company reserves the right to deny the Client a full refund at the discretion of the Company.
For the Client to cancel the services provided by the Company, the Client is obliged to submit a ticket through the Company's support ticket system at least 8 days prior to the next invoice as set forth by the Company. The Company does not recognize and does not provide any other form or method of cancellation to the Client, regardless of situation. Requests to downgrade the services of the Client must be submitted through the Company's support ticket system. Requests to upgrade or increase the services of the Client must be submitted through the support ticket system of the Company. The Company does not recognize and will not act upon any other request to downgrade or request to upgrade submitted to the Company through any method other than those which are set forth by the Company in this TOS.
In agreement to this TOS, the Client also agrees to follow the regulations set forth by the AUP set forth by the Company completely and entirely. In the event that the Client is recognized by the Company to not be completely and entirely following the AUP set forth by the Company, the Company reserves the right to suspend or terminate all services associated with the Client.
Services provided to the Client by the Company are provided as is and do not carry any guarantee or warranty whatsoever other than those that may be set forth in this TOS. The Company is not liable for any data lost from the service provided to the Client for any reason.
The Company respects and recognizes all DMCA complaints to the Company, and will comply with all official takedown notices received from the respective copyright holder. The Company will respect copyright takedown requests and reports of copyright infringement submitted to the Company through the "Abuse Department" of the Company's support ticket system or via email at the Company's abuse email address at abuse@ideal-hosting.biz. The Company will not respect nor recognize any copyright takedown request or report of copyright infringement submitted to the Company in any method other than the methods set forth in this TOS.
The Company will attempt to provide service to those who request service from the Company. However, the Company reserves the right to reject any requests of service and to refuse service to any Client at the discretion of the Company.
VPS accounts provided by the Company to the Client are provided with 1 IP address. Additional IP addresses are provided on request at a cost set forth by the Company. The Client recognizes that the IP addresses issued by the Company are the sole property of the Company and the Client does not retain any ownership rights to any IP address issued to the Client or any of the services of the Client, including, but not limited to, the transfer of IP addresses from the Company to another host. Any extra IP addresses provided to the Client must be justified under RIPE/ARIN regulations and are subject to availibility.
