Clients are permitted unrestricted access to the public and private network so long as the Client does not misuse the network in any way, defined by the Company and by appropriate public network laws and regulations set forth by local, provincial, and federal governments in question. In violation of this AUP, the Company shall review and take action upon the specified violation of this AUP at the Company's discretion. The Client assumes full liability for all content placed on the server provided to them through the services provided to the Client by the Company. Forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting is regarded as a violation of this AUP.
The Client agrees to not sabotage the services provided by the Company in any way, shape, or form, regardless of intention. This included, but is not limited to, abuse of the remote/reinstall reboot system to reboot/reinstall multiple times in a short amount of time for reasons deemed improper by the Company. The Company reserves the right to terminate all Client services in the event of sabotage of services by the Client.
The Client assumes reponsibility and liability for the security of the service provided to them by the Company. The Company is not liable for account termination or additional charged that are incurred due to lack of monitoring or security from the Client.
The Company is not obliged to monitor the content on its servers. In the event a formal complaint is issued to the Company through the support ticket system of the Company or through the abuse email address located at abuse@ideal-hosting.biz, the Company will review the questionable content put forth by the complaint. The Company will not take action against any content that is not deemed by the Company to be in violation of local, provincial, or federal law, this AUP, or the established TOS. Content that is deemed to be in violation of the aforementioned rules and regulations will be reviewed by the Company and necessary action will be taken in order to remove or modify content that is deemed in violation of this AUP. The Company reserves the right to terminate accounts of services of the Client in order to fully remove or modify the content that was deemed in violation of this AUP.
If the Client or any third-part user regarded as a customer of the Client uses the services, network, or physical infrastructure of the Company in a manner that causes the Company, or any IP addresses issued by the Company, to be "blacklisted" or "blocked" from an institution, then the Company reserves the right to suspend or terminate all services associated with the Client and to deny access of the Client to the services, network, and/or physical infrastructure of the Company. Any Client operating or reselling services of the Company on behalf of, or in connection with any persons or firms listed in the Spamhaus Register of Known Spam Operations database at www.spamhaus.org shall be regarded as in violation of this AUP.
All services provided by the Company may only be used for lawful purposes. The laws and regulations of Germany apply. The customer agrees to indemnify and hold harmless the Company from any claims resulting from the use of our services. Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, graphics, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of anothers copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. If you believe that your copyright or trademark is being infringed upon, please email abuse@ideal-hosting.biz with the information required. A list of required information may be found on the Terms of Service page. If the request is of a licensing issue, we may require further documentation. The Client agrees to not use the services provided by the Company in order to display pornographic adult content, to distribute warez files, or to provide a TOR exit node. The Company reserves the right to remove or modify the content of a service provided to the associated Client in order to comply with the Content Policy established in this AUP.
The company takes a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and purchased lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice. Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. The company reserves the right to require changes or disable as necessary any gameserver, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion. The company reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal. This cost of the clean up fee is entirely at the discretion of the company.
